Chip company sues for message board defamation

OUT-LAW News, 09/04/2001

MeltroniX, a publicly traded chip design company based in San Diego has said that, as a result of a lawsuit filed several weeks ago, it has discovered the identities of anonymous internet posters who allegedly defamed it in a Raging Bull chatroom.

A former employee and individuals whom the company believes have ties to a local, privately held rival, have, according to MeltroniX, “repeatedly engaged in sending what the company believes to be vicious, defamatory and damaging messages.”

The company is seeking monetary and punitive damages against these individuals who it says masqueraded as investors and repeatedly denied having been former employees or having been motivated by anything other than investor commentary.

“MeltroniX respects the First Amendment Rights that protect the postings of our investors and the internet's ability to provide a broad based forum for our investors to discuss the company and its progress,” stated Andrew K. Wrobel, Chairman, President, and CEO of MeltroniX. He continued:

“We also believe that these unwarranted attacks against the company were not initiated by our investors, but were the result of a former employee vindictively attacking the company, and a privately held competitor utilising the Raging Bull to drive down the value of our company. We have been forced, by their actions, to utilise all legal options to hold them legally accountable for their actions. We believe that at this time, the lawsuit, and their identities, are a matter of public record. We have also worked hard to distinguish between those we identify as legitimate investors, and those whose motives are suspect.”
