Jail threat in Denmark for linking to on-line casinos

OUT-LAW News, 17/08/2001

The Minister of Taxes in Denmark has warned that any Danish web site hosting a banner ad for an on-line casino or betting site, whether Danish or foreign, is running a risk of jail if clicking the ad takes the visitor to the gaming site, according to a report by Europemedia.net.

The Minister’s view appears to be that gambling sites are not illegal if the operators have a suitable licence. Further, dormant adverts for such sites can legally appear on third party web sites. However, his argument seems to be that sites offering a link via an advert to such sites are, under Danish law, illegally running a betting service.

This week, according to Europemedia.net, a Danish newspaper was charged for linking from its web site to a foreign bookmaker. The editor could go to jail and the news site faces a fine of DKK100,000 (around £8,500).
