Nominet wins court order against domain name sellers

OUT-LAW News, 04/12/2002

The Chancery Division of the High Court has issued on Friday a temporary court order, banning Domain Registrar Services Ltd (DRS), one if its directors and UK Names Ltd from using the name or trade marks of Nominet UK.

Nominet is the registry for all domain names ending .uk. It controls the database of all names that are sold by registrars. It sued the two companies for using sales techniques which implied that the companies were affiliated with or endorsed by Nominet and for trade mark infringement by using Nominet's logo without permission.

The court order, which will remain in force until it is altered by the court or until the final judgment of the case, stops DRS and UK Names from advertising or offering to sell domain names or associated internet products or services under the Nominet name or logo. The order also bars the companies from passing themselves off as being connected with Nominet.
