The current Code applies to telecoms licence holders and makes provision for them to have access to public and private land for the purpose of developing communications networks. This will not change, but the Code is now being extended to all communications providers.
For the first time under the new arrangements, non-network providers such as local authorities and other utility companies will be able to apply for the Code if they are installing infrastructure that will be used by communications providers.
This, says Oftel, will play an important part in improving competition in the provision of communications infrastructure and will help the development of electronic communication services.
David Edmonds, Director General of Telecommunications said today:
"The Code will only be issued to companies who are providing communication services or infrastructure to communications providers - and all companies will have to demonstrate the public benefit of the infrastructure they intend to provide."
The deadline for comments on the consultation is 28th May 2003.
