Xbox owner sues Microsoft

OUT-LAW News, 01/11/2004

Microsoft found itself the target of a potential class action lawsuit on Wednesday after an angry Xbox owner sued in the Los Angeles Superior Court, alleging that the games console is defective, according to reports.

Sean Burke filed the suit when he became frustrated that his Xbox, which was less than a year old, had stopped working properly.

"The defective Xboxes stop working after minimal usage, after unreasonably, unconscionably, unusually and unexpectedly short amounts of time," says the filing, according to Reuters.

Burke is seeking class action status for his suit, which would allow other US Xbox owners, who had purchased their console between 2001 and 2004, to join in the action.

Microsoft would not comment, other than to state, "We've designed and manufactured the Xbox with the highest quality standards and our customer satisfaction is very high," reports Reuters.
