HP and EMC settle patent dispute

OUT-LAW News, 04/05/2005

Hewlett-Packard ( HP ) will pay $325 million to EMC Corporation to settle a long-running dispute over data storage patents. The two firms have also signed a five-year agreement to use each others' patents.

The dispute dates back to 2002, when HP sued, accusing information storage producer EMC of infringing on seven of its patents for data storage technology. In response, EMC accused HP of infringing at least six of its own patents.
As part of the settlement, HP will pay a net $325 million balancing payment to EMC , which can be satisfied through the purchase for resale or internal use of EMC products over the next five years.
Both parties say the settlement is amicable, with neither of them admitting liability. Their spokesmen added that the deal protected their respective intellectual property rights and would benefit their customers.
